Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the Benchpress platform and services (“Service”) operated by Curl Budget LLC (“Company,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

By using the Service, you represent and warrant that:

  • You are a registered PACER user in good standing with the Administrative Office of the U.S. Courts;
  • All information you provide to us is accurate and complete;
  • You will use the Service only for lawful purposes and in accordance with these Terms.

2. Description of Service

Benchpress provides tools to search federal court dockets, track cases, receive notifications of new docket entries, and view or download court filings. The Service integrates with PACER (Public Access to Court Electronic Records) and CourtListener. You must provide your own PACER credentials to access PACER data through the Service.

3. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We encrypt your PACER credentials at rest using AES-256-GCM encryption and never store passwords in plaintext.

You may not share your account credentials, allow multiple individuals to use a single account, or use automated means to access the Service without our prior written consent.

4. PACER Fees and Charges

PACER charges per-page fees for accessing court documents. These fees are assessed directly by PACER to your PACER account and are separate from any fees charged by Benchpress. You are solely responsible for all PACER costs incurred through your use of the Service. We do not mark up, surcharge, or otherwise modify PACER fees.

5. Subscription and Payment

Benchpress offers a 30-day free trial. After the trial period, continued access requires a paid subscription. Subscriptions are billed monthly. No refunds will be issued for partial months of service. We reserve the right to change subscription pricing with 30 days' advance notice.

6. Cancellation and Termination

You may cancel your subscription at any time by contacting us. Cancellation takes effect at the end of the current billing period. We may suspend or terminate your access if you violate these Terms or fail to pay applicable fees after a 30-day cure period.

Upon termination, your right to access the Service ceases immediately. We may delete your account data, including stored PACER credentials and tracked case information, following termination.

7. Intellectual Property

The Service, including its design, code, and documentation, is owned by Curl Budget LLC and protected by intellectual property laws. We claim no ownership rights over court records or documents accessed through the Service. You retain all rights to any content you upload or create.

You may not modify, reverse engineer, decompile, or create derivative works based on the Service without our prior written consent.

8. Prohibited Conduct

You agree not to:

  • Use the Service in any way that violates applicable law or regulation;
  • Interfere with or disrupt the Service or its underlying infrastructure;
  • Attempt to circumvent PACER billing or access controls;
  • Use the Service to transmit malware, spam, or other harmful content;
  • Scrape, crawl, or use automated tools to extract data from the Service in bulk;
  • Impersonate any person or entity or misrepresent your affiliation.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

We do not guarantee the accuracy, completeness, or timeliness of any court data retrieved through the Service. PACER data is provided by the federal courts and may contain errors or delays. You should independently verify any information obtained through the Service before relying on it for legal purposes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURL BUDGET LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us (excluding PACER fees) during the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Curl Budget LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Washington.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on the Service with at least 30 days' advance notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
